因此，法院认为被申请人已默示接受合伙协议及其包括仲裁条款在内的条款。 为了得出这一结论，法院依据的是被申请人在签署合伙协议之后、立案之前发送的一封信函。在这封信中，被诉人称：“您（申诉人）与ABC代表我们签订的合同……”。法院以其充分的自由裁量权得出结论，被申请人发送的信件中使用此类语言明确表明被申请人接受合伙协议、其有效性及其全部内容。 此外，最高法院在作出判决时也考虑到了被告所犯的错误。被申请人在之前提交的一份材料中声称，该问题在未遵循合伙协议中所载仲裁条件的情况下过早提交仲裁。法院认真考虑了被诉人提出的这一意见，以巩固其判决，即被诉人事实上已接受合伙协议，因此同意受包括仲裁条款在内的条款的约束。
